Server Rental and Hosting Service Agreement

SERVICE PROVIDER: Limitsiz Bulut Bilişim Teknolojileri (Kocaeli / Kartepe Köseköy Mahallesi, Alemdar Vergi Dairesi) CUSTOMER: The natural or legal person who purchases a Virtual Server (VDS/VPS), Rented Server (Dedicated) or Co-location service via www.limitsizbulut.com.

• Unless purchased as a "Managed" package as expressly stated in writing, servers are delivered as UNMANAGED.
• The operating system, software installations, licensing, security configuration and database settings are exclusively the Customer's responsibility.
• Where technically necessary, server hardware is replaced free of charge with an equivalent or higher model. IP address changes are notified at least 7 days in advance.

BACKUP IS ENTIRELY THE RESPONSIBILITY OF THE CUSTOMER:

• Regardless of the package or server type, backing up data, storing it at a separate geographic location and testing the backups is entirely the Customer's responsibility.
• Limitsiz Bulut cannot under any circumstances be held liable for loss of data or business revenue arising from hardware/disk failures, operating system crashes, data corruption, ransomware or user error.
• Limitation of Liability: The total financial liability that may arise from a technical failure or defect is limited to the 1 (one) month service fee paid by the Customer for the period in which the failure occurred.

Where internet access/hosting is provided to third parties via the server, keeping internal IP allocation logs as required by Law No. 5651 is the Customer's responsibility. SPAM sending, DDoS/botnet/brute-force tools, warez/pirated broadcasting, IPTV, phishing, illegal betting and child pornography are strictly prohibited on the servers. Upon detection of a violation, the server is shut down without notice and the agreement is terminated.

Servers whose renewal invoice is not paid at the end of the term are suspended. Data Deletion Procedure: Data on servers suspended due to an overdue invoice is permanently deleted within 7 (seven) days at the latest from the date of suspension, for the purposes of data security and the release of resources. No refund is made for servers shut down due to rule violations.

The Courts and Enforcement Offices of Kocaeli (İzmit) have exclusive jurisdiction over disputes that may arise from this Agreement.
